A constructed reality (often called the Social Construction of Reality) means that human beings collectively create and agree upon what is „real,“ „normal,“ or „true“ through social interaction, language, and culture rather than finding it as a fixed law of nature. [1]
Core Ideas
Not purely physical: While physical objects like trees and rocks exist independently, the meaning and rules around things come from people.
Shared agreements: Society works because people act as if certain unwritten rules, values, and roles are absolute facts.
Shaped by language: People use words and communication to build a shared framework for understanding the world. [1]
Common Examples
Money: A paper bill or digital number has no real value on its own; it works only because everyone agrees it can buy things.
Time and Calendars: Hours, days, and years are human-made systems to organize life.
Social Roles: Ideas of what a „boss,“ „teacher,“ or „citizen“ should do are taught and expected by society.
Fictio cedit veritati; fictio iuris non est ubi veritas.
Fiction yields to truths; there is no legal fiction where there is truth.”
A maxim meaning that tribunals rely on judicial fictions only in the absence of adequate evidence on the matter at issue.
Sometimes abbreviated Fictio iuris non est ubi veritas.
